PRINC\u00cdPIOS EXPL\u00cdCITOS (LIMPE)<\/h2>\n\n\n\n<p class=\"\">Os princ\u00edpios expl\u00edcitos s\u00e3o aqueles expressamente previstos no caput do Art. 37 da CF\/88. O acr\u00f4nimo <strong>LIMPE<\/strong> facilita a memoriza\u00e7\u00e3o:<\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">1.1 LEGALIDADE<\/h3>\n\n\n\n<p class=\"\"><strong>Conceito:<\/strong> A Administra\u00e7\u00e3o P\u00fablica s\u00f3 pode fazer o que a lei permite ou autoriza. \u00c9 o princ\u00edpio da <strong>supremacia da lei<\/strong>.<\/p>\n\n\n\n<p class=\"\"><strong>Caracter\u00edsticas:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\"><strong>Para o Administrador P\u00fablico:<\/strong> S\u00f3 pode agir quando autorizado por lei (crit\u00e9rio de subordina\u00e7\u00e3o)<\/li>\n\n\n\n<li class=\"\"><strong>Para o Particular:<\/strong> Pode fazer tudo que a lei n\u00e3o pro\u00edbe (crit\u00e9rio de n\u00e3o contradi\u00e7\u00e3o)<\/li>\n<\/ul>\n\n\n\n<p class=\"\"><strong>Implica\u00e7\u00f5es para a Administra\u00e7\u00e3o:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">Todo ato administrativo deve ter fundamento legal<\/li>\n\n\n\n<li class=\"\">Necessidade de lei pr\u00e9via para criar obriga\u00e7\u00f5es, proibi\u00e7\u00f5es ou san\u00e7\u00f5es<\/li>\n\n\n\n<li class=\"\">Vincula\u00e7\u00e3o estrita aos comandos legais<\/li>\n\n\n\n<li class=\"\">Impossibilidade de agir por mera conveni\u00eancia sem amparo legal<\/li>\n<\/ul>\n\n\n\n<p class=\"\"><strong>Implica\u00e7\u00f5es para o Particular:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">Direito de exigir que a Administra\u00e7\u00e3o atue dentro dos limites legais<\/li>\n\n\n\n<li class=\"\">Possibilidade de invalidar atos ilegais via controle judicial<\/li>\n\n\n\n<li class=\"\">Seguran\u00e7a jur\u00eddica nas rela\u00e7\u00f5es com o Poder P\u00fablico<\/li>\n\n\n\n<li class=\"\">Previsibilidade da atua\u00e7\u00e3o estatal<\/li>\n<\/ul>\n\n\n\n<p class=\"\"><strong>Exemplos Pr\u00e1ticos:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">\u2705 Servidor s\u00f3 pode ser contratado por concurso p\u00fablico (art. 37, II)<\/li>\n\n\n\n<li class=\"\">\u274c Administrador n\u00e3o pode criar cargo p\u00fablico por decreto<\/li>\n\n\n\n<li class=\"\">\u2705 Cidad\u00e3o pode questionar judicialmente multa sem previs\u00e3o legal<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">1.2 IMPESSOALIDADE<\/h3>\n\n\n\n<p class=\"\"><strong>Conceito:<\/strong> A Administra\u00e7\u00e3o deve tratar todos de forma igualit\u00e1ria, sem discrimina\u00e7\u00f5es ben\u00e9ficas ou prejudiciais.
